And one of those naturally abundant areas is the Gulf of Mexico. In fact, oil produced in the Gulf of Mexico accounts for approximately 15% of our country’s total crude oil production.
That means the Gulf of Mexico is absolutely critical to our energy strategy. Despite this, the Biden Administration has continually failed to prioritize oil and gas lease sales in the region, having only held two rounds of lease sales since 2021.
Now, the National Marine Fisheries Service (NMFS) wants to add even more uncertainty to the mix for offshore energy leasing and development with a newly proposed regulation.

In the proposed regulation, the NMFS is considering designating a significant stretch of the Gulf of Mexico as critical habitat for the endangered Rice’s whale. This could lead to future restriction on all users of the Gulf. So far these restrictions are only targeted at oil and gas activities, as previewed in a lawsuit settlement reached just before the proposed rule was published. These restrictions would limit nighttime and low visibility transit across areas between 100- and 400-meters water depth and would knock 6 MILLION acres off the table for future lease sales.
And more importantly, these restrictions specifically single out oil and gas vessels. This is a baffling proposal given thousands of other ships pass through the area every day.
NMFS’s peculiar targeting of the oil and gas industry seems fishy to us. It all-too-conveniently creates a victory for anti-oil and gas groups just weeks before an offshore leasing sale is set to take place.
We know we have the resources, talent, and know-how to produce energy here in America affordably, efficiently, and reliably. But regulations like these only make this goal more difficult.
